This document sets out the Terms and Conditions for the Midas 400 Russell Ingall Hot Lap promotion 2008.

Russell Ingall Hot Lap Promotion
 

1. Information on how to enter forms part of these terms and conditions. Entry into this competition is deemed to be acceptance of these terms and conditions. Entries not completed in accordance with these terms and conditions are ineligible.
2. Entry is open to all residents of Australia. Employees and their immediate families of Ticketmaster, International Management Group of America Pty Limited, Telstra Big Pond and agencies associated with this promotion are ineligible to enter.
3. The promotion commences at 8am on 21/05/2008 and closes at 5pm on 4/06/2008.
4. To enter, consumers must pre-purchase a ticket to the Midas 400 from Ticketmaster before 5pm on 4/06/2008 by phone, at a Ticketmaster outlet or on the internet during the promotional period. All entires will automatically go into the draw.
5. The first entry drawn will win one hot lap with Russell Ingall (or other driver as advised by the Promoter) in a V8 Supercar at Sandown International Raceway on Saturday 7/06/2008 and one entry pass to the race circuit for that day. The prize is valued at $1,500 incl. GST.
6. All costs and expenses incurred by the winner in taking up this prize (including, but not limited to, all travel and accommodation costs) are the responsibility of the winner. 
7. This prize can only be redeemed during the 2008 Midas 400, Sandown International Raceway, 7-9 June (inclusive), at the  time advised by the Promoter.
8. The draw will be conducted at 10am on 5/06/2008 at the Ticketmaster Office, Level 7, IBM Centre, Southbank Victoria 3006, Australia. The draw will involve the random selection of one entry.
9. The winner will be notified by telephone and in writing. The name of the winner will also be published in the Herald Sun newspapers on 6/06/2008 The judges’ decision is final and no correspondence will be entered into.
10. Prize values are the recommended retail value as provided by the supplier(s) and are correct at the time of printing. No responsibility is accepted for any variation in the value of the prizes. All prize values are in Australian Dollars.
11. Prizes are not transferable and cannot be taken as cash.
12. Prize winners are advised that tax implications may arise from their prize winning and they should seek independent financial advice prior to acceptance of that prize.
13. In the event that a prize is won by a person under the age of 16, the Promoter may direct that the prize be transferred to a parent or guardian of the winner.
14. Motorsport is dangerous. If the Promoter deems that the provision of the prize will expose the winner or any other person to unreasonable safety risks, the Promoter may chose not to award the prize and will instead award an alternative prize of equivalent value to the winner.
15. In the event that for any reason whatsoever the winner of a prize does not accept the prize, or any part thereof, at the time stipulated by the Promoter, then the prize, or any part thereof, will be forfeited by the winner.
16. To be eligible to win the prize, the winner must not only be drawn in the draw but must also agree to sign a waiver and indemnity form (the form) and be bound by any other safety or timing conditions set by the Promoter, the driver or the V8 Supercar race team providing the Hot Lap prize to the winner. As a safety precaution, the successful entrant will be required to comply with physical and medical requirements set out by the Promoter.  In the event that the winner is unfit to redeem the prize, the prize is transferable.  Should the winner either fail or refuse to sign the form when requested to do so by the Promoter, then the Promoter reserves the right to conduct further draw(s) if necessary until an eligible entrant is selected as the winner who satisfies this eligibility criteria to receive the prize.  All entrants acknowledge and agree that the form is necessary in light of the potential danger or harm that may be occasioned by receiving prize should they be the winner of the competition.
17. It is the sole responsibility of the winner to make all necessary arrangements to ensure their availability and entry into the event to sign and comply with the form and to also receive the prize when the Promoter decides to provide the prize.  All entrants to the competition (including the winner) acknowledge that it is their sole responsibility to follow all directives of these parties regarding receipt of the prize and if not followed may result in the winner failing to receive the prize and in which case they shall not be entitled to receive any other prize, compensation or other form of entitlement in lieu.
18. The Promoter shall not be liable for any loss, damage, personal injury or death whatsoever which is or may be suffered (including but not limited to indirect or consequential loss) or for personal injury which is or may be suffered or sustained, in connection with the prize, except for any liability which cannot be excluded by law.
19. The Promoter at all times reserves the right to withdraw, cancel or substitute the designated prize with another prize of similar or like value without notice to any entrants should such withdrawal, cancellation or substitution be deemed necessary in the promoter’s sole discretion. In such situation, all entrants agree to be bound by these changes as part of the conditions of entry into the competition and forego any rights or entitlements resulting from such change to the competition.
20. No responsibility is accepted for any late, lost or misdirected entries.  Incomprehensible entries will not be accepted.
21. All entries become the property of the Promoter. Entrants’ details will be retained for the “Sandown 400 Hot Lap” promotion only. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner notifies the Promoter at the time of entry into the competition that he/she does not wish for the Promoter to use their name and photograph for promotional purposes.  Each entrant consents to the Promoter using information provided in connection with the competition for the purposes of facilitating the conduct of the promotion and awarding any prize.
22. Entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available at http://www.sandown400.com.   If you would like to access or correct the personal information that the Promoter holds about you, or if you do not wish your information to be disclosed, please advise the Promoter by contacting the Promoter’s Privacy Officer as set out in the Privacy Policy.
23. By entering into the competition, you agree and acknowledge that if you are the winner:
(a) you may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of the winners of the competition;

(b) the Promoter may use such comments or photos (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to you;

(c) the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means.  The Promoter may licence, authorise or otherwise transfer the rights in the Materials to others to do the same;

(d) you acknowledge that the Promoter retains the rights, title and interest, including in the copyright to any other right in the Materials and, to the extent permissible by law, you waive and/or assign to the Promoter all such rights which might, but for these terms and conditions, arise;

(e) you unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of your moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by stature anywhere in the world whether occurring before or after this consent is given ("Moral Rights");

(f) you waive all your Moral Rights in the Materials that arise outside Australia; and

(g) you agree not to institute, maintain or support any claim or proceeding for infringement of your Moral Rights in the Materials.
