Terms and Conditions of entry in The Big Canberra Bike Ride incorporating Amy's Ride

Please read carefully before completing your registration

These Conditions of Entry are designed to enable the Big Canberra Bike Ride incorporating Amy's Ride event to run smoothly and safely. By registering to participate in the Big Canberra Bike Ride incorporating Amy's Ride, you (the 'Rider') accept, agree to and are bound by these Conditions of Entry.

Entry Requirements

  1. All Riders must accept the Conditions of Entry.
  2. If the Rider is under the age of 18 on the day of the Big Canberra Bike Ride incorporating Amy’s Ride, a Parent or Guardian of the Rider must accept the Conditions of Entry on behalf of the Rider.
  3. If the Rider is aged 18 years or younger on the day of the Big Canberra Bike Ride incorporating Amy's Ride, a Parent or Guardian must be accompanied the Rider on the Big Canberra Bike Ride incorporating Amy's Ride.
  4. Children, under 12 years old, must be carefully monitored by a Parent or Guardian throughout the Big Canberra Bike Ride incorporating Amy's Ride.
  5. Pedal Power ACT may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application for registration.
  6. A username and password will be issued for each rider’s registration (emailed after email address has been saved in registration), with these login details riders are able to make changes or additions to the rider’s registration.

Rider categories for fee structure

  1. An adult is defined as a person who is 18 years or older on the Ride day.
  2. A youth is defined as a person who is 13 years or older on the Ride day and not yet 18 years old on the Ride day.
  3. A child is defined as a person who is 3 years or older on the Ride day and not yet 13 years old on the Ride day.
  4. Child entries are not accepted in the 105km ride option.
  5. The Family registration is only available for the 28km ride option. A family registration must have more than 2 and less than 6 members, have at least 1 adult and no more than 2 adults.
  6. If the Rider is a Pedal Power member, the Rider is entitled to $5 discount on the individual registration fee, on the provision of a valid membership number.
  7. The Pedal Power membership discount does not apply to the Family registration or for registrations received after midnight Thursday 15 March.

Cancellations

  1. If the Rider wishes to cancel his/her participation in the Ride, the Rider must notify Pedal Power ACT in writing or email to office@pedalpower.org.au, providing his/her name, address, event entered and reason for cancelling.
  2. Written cancellations received before Midnight Thursday 23 February 2012 will be refunded 75% of their entry fee.
  3. Written cancellations received after Midnight Thursday 23 February 2012 and before Midnight Thursday 8 March 2012 will be refunded 50% of their entry fee.
  4. No refunds will be offered for cancellations received after Midnight Thursday 8 March 2012.
  5. Except as otherwise stated in these Entry Terms, the Pedal Power ACT is under no obligation to refund monies or entry fees due to non use, cancellation, failure to participate or dissatisfaction by the Rider.

Transfers

  1. The Rider may transfer his/her registration for the Ride via the online registration.
  2. Transfers will incur a $5 administration fee. The transfer fee must be paid online by the person giving up the registration.
  3. The new rider reimburses the registration cost directly to the rider giving up the registration.
  4. The new rider must confirm the transfer is complete via the transfer confirmation email received after the administration fee has been paid.

Merchandise

  1. The Big Canberra Bike Ride incorporating Amy’s Ride event jersey is an optional purchase and is not included in the registration fee for 2012.
  2. Merchandise must be purchased online via the registration website and are available until Midnight Thursday 8 March 2012 or until sold out (whichever is earlier)
  3. All purchases will be posted on Friday 9 March 2012.
  4. Please choose carefully and refer to the Body Torque size chart to confirm your preferred event jersey size (Available in men's sizes only)
  5. If your merchandise is not the correct fit, please contact the AGF to check if your preferred size is still available as stock is limited.
  6. If the exchange cannot be processed, a full refund on the item (less p/h fee) will be provided on the basis the merchandise is returned unworn and with tags still attached to the AGF.

Communications

  1. Communications in relation to Big Canberra Bike Ride incorporating Amy’s Ride will principally be made via email. Riders should therefore provide a valid email address. If a Rider does not have access to an email address, the Rider should make every effort to read the Big Canberra Bike Ride incorporating Amy’s Ride website that will be updated as necessary until the date of Big Canberra Bike Ride incorporating Amy’s Ride.
  2. It is the Rider's responsibility to read all information that is made available on the Big Canberra Bike Ride incorporating Amy’s Ride website, in emails, newsletters and all other literature concerning the Big Canberra Bike Ride incorporating Amy’s Ride.

Mode of Transport

  1. Riders are to ride standard human-powered bicycles including tricycles, unicycles and kick bikes in Big Canberra Bike Ride incorporating Amy's Ride. Scooters, motorised and power-assisted bicycles are prohibited in Big Canberra Bike Ride incorporating Amy's Ride.

Closing Dates for entries

  1. Online entries for the Ride which includes rider kit postage close Midnight Thursday 8 March 2012.
  2. Online entries for the Ride close Midnight Thursday 15 March 2012.
  3. Online entries received between Midnight Thursday 8 March and Midnight Thursday 15 March will be required to collect their rider kit at the times listed below.
  4. Late entries can only be made at Federation Mall behind Old Parliament House between 2:00 -5:00pm Saturday 17 March or between 7:00-9:00am Sunday 18 March 2012.
  5. A $5 administration fee will be applied to entries received on Saturday 17 March and Sunday 18 March 2012.

Acknowledgment and Waiver

  1. The Rider acknowledges and agrees that participation in the Big Canberra Bike Ride incorporating Amy's Ride carries risk and that she/he participates in the Big Canberra Bike Ride incorporating Amy's Ride at her/his own risk.
  2. The Riders accept the following Conditions of Entry

I accept the terms and conditions of entry and have read the rules and guidelines and the insurance guidance.

I accept these conditions of entry and have read in full the conditions of entry, the guidelines and insurance guidance.

I understand that cycling can be a hazardous activity, particularly in traffic or among pedestrians.

I accept that when riding I am at risk and may suffer or cause injury or property loss or damage. I will take care to avoid injury or damage to others and myself.

I confirm that I and any children in my care have sufficient competence and experience to participate safely in the Big Canberra Bike Ride incorporating Amy’s Ride .

I accept that Pedal Power limits its liability.

It is a condition of participating in Big Canberra Bike Ride incorporating Amy’s Ride that I waive, to the extent permitted by law, any claim, right or cause of action which:

  • I personally; and
  • each child in my care; and
  • my heirs, executors and administrators and those of each child in my care

may have in contract and civil wrongs law, arising from any personal injury, damage or loss arising out of the ride.

I accept that this release from liability operates in contract law in favour of Pedal Power ACT Incorporated, and all officers, members, volunteers and employees of Pedal Power and all sponsors of the ride or event and operates whether the damage is due to any act or neglect of any of them.

I understand that I should have my own personal liability insurance and accident cover and that current financial members of Pedal Power are covered by PedalPower’s third party legal liability and personal accident insurance policy as outlined in the insurance guidance.

If a Rider is under 18 years old, an adult must accompany them throughout the ride, unless otherwise agreed in writing by Pedal Power.

If an entrant is under 18 years old, a parent or guardian must accept the conditions of entry by clicking 'I accept (below) the terms and conditions' and paying with their credit card.

Compliance with Laws

  1. During the Big Canberra Bike Ride incorporating Amy's Ride, Riders must comply with all traffic and road laws, all directions issued by Police and all instructions given by Pedal Power ACT or any employees or officials representing Pedal Power ACT at the Big Canberra Bike Ride incorporating Amy's Ride. Failure to do so may result in disqualification of the Rider from Big Canberra Bike Ride incorporating Amy's Ride.
  2. The Rider must wear an undamaged Australian Standard approved cycling helmet at all times during Big Canberra Bike Ride incorporating Amy's Ride while riding a bicycle.

Preparation, Training, Health and Safety

  1. The Rider is responsible for ensuring that he/she is adequately and appropriately prepared, both physically and mentally, for the Big Canberra Bike Ride incorporating Amy's Ride. If the Rider has any health issues or doubts prior to the Big Canberra Bike Ride incorporating Amy's Ride, he/she should immediately seek appropriate medical advice.
  2. If the Rider becomes ill or injured during the Big Canberra Bike Ride incorporating Amy's Ride, Pedal Power ACT will endeavour to arrange medical transport, usually in an ambulance. Any medical transport will be at the Rider's expense. (Pedal Power ACT recommends that Riders hold current ambulance service membership and/or health insurance to cover such costs; Pedal Power ACT valid membership includes public liability and personal accident insurance; non Pedal Power ACT members will receive coverage under Cycling Australia’s third party legal liability and personal accident insurance policy.)
  3. The Rider's bicycle needs to be in a good working condition prior to riding in the Big Canberra Bike Ride incorporating Amy's Ride. All bicycles used in the Big Canberra Bike Ride incorporating Amy's Ride may need to pass a brief safety check on arrival. If, in the opinion of Pedal Power ACT, a bicycle is unsafe, it cannot be used in Big Canberra Bike Ride incorporating Amy's Ride.

Common Sense

  1.  The Rider when in Big Canberra Bike Ride incorporating Amy's Ride must ride and otherwise behaves in a safe and responsible manner and use common sense at all times.
  2. The Rider when in Big Canberra Bike Ride incorporating Amy's Ride must exercise caution on all public roads and other thoroughfares and ride defensively and courteously.

Big Canberra Bike Ride variation

  1. Pedal Power ACT reserves the right, in its absolute discretion, to:

(a) change or vary the route of any of the Big Canberra Bike Ride incorporating Amy's Ride rides without notice (such change or variation is only likely to occur when fire, flood, road damage or other causes hinder access to the proposed route);

(b) cancel, postpone, reschedule or change the time or place for the Big Canberra Bike Ride incorporating Amy's Ride or any of the Big Canberra Bike Ride incorporating Amy's Ride rides for any reason and at any time prior to the commencement of the Big Canberra Bike Ride incorporating Amy's Ride rides.

      2. Pedal Power ACT is not responsible for or liable to the Rider for any loss, damage, cost or expense, whether direct, indirect, consequential or otherwise and howsoever or wheresoever incurred by the Rider resulting from any such action taken by Pedal Power ACT.

 Private support vehicles

  1. Private support vehicles are not permitted on the course during Big Canberra Bike Ride incorporating Amy's Ride.

Photography

  1. The Rider acknowledges and agrees that he/she may be photographed or filmed during the Big Canberra Bike Ride incorporating Amy's Ride and consents to Pedal Power ACT using the Rider's picture and likeness contained in any photographs or film for publicising the Big Canberra Bike Ride incorporating Amy's Ride and for promoting any future ride or event to be staged by Pedal Power ACT or the Amy Gillett Foundation or for other purposes by Pedal Power ACT or the Amy Gillett Foundation.

Privacy

  1. The AGF, Pedal Power and Heart Foundation ACT collects, uses, discloses and otherwise handles the Rider's personal information in accordance with the terms of each companies Privacy Policy Statement (search ‘Privacy’ on www.amygillett.org.au, www.pedalpower.org.au, www.heartfoundation.org.au). 
  2. The Rider’s contact details will be used by Pedal Power ACT, the AGF and/or third parties involved in the delivery of the event. Any correspondence sent from these entities would be restricted to future events, news, and promotions. These communications include the ability to opt-out.
  3. Should the Rider not wish to be contacted for any other reason other than to be provided with information about the Big Canberra Bike Ride incorporating Amy’s Ride event, please advise Pedal Power ACT by emailing office@pedalpower.org.au.

The Amy Gillett Foundation Fundraising Conditions

  1. Highest Fundraising Individual: wins a HED Ardenne SL wheel set. With a retail value of $1500 for the set, these wheels have been a big seller in the US. The HED C2 rim - By obsessing over design, and with the modern miracle of CAD, the C2 rim is 23mm wide and only 430g.  
  2. Highest Fundraising Team: wins a $500 gift voucher from www.BikeExchange.com.au  
  3. Minimum fundraising amount of $500 is required to be eligible for any prize
  4. The Fundraising Challenge will close 9am Monday 2 April 2012
  5. Prize winners will be announced 10am Monday 2 April 2012.
  6. If Postage of the HED wheels and BikeExchange.com.au voucher items is required, this is at the expense of the winner.
  7. The AGF and Register Now accept no responsibility for any late, lost or misdirected fundraising commitments including pledges/commitments not received by the AGF or Register Now or delays in the delivery of the message due to technical disruptions, network congestion or for any other reason. 
  8. Prize can be transferred however cannot be redeemed for cash.  If the prize is unavailable, for whatever reason, the AGF reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
  9. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The AGF accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

Heart Foundation Fundraising conditions

  1. Individuals who raise more than $500 on Everyday Hero www.everydayhero.com.au for the Heart Foundation in the Big Canberra Bike Ride incorporating Amy’s ride will be entitled to a FREE massage at the Heart Foundation marquee at the completion of their ride.
  2. Individuals must achieve or exceed the $500 fundraising target by March 18, 2012 at 10am to be eligible for the massage.

Other items

  1. Big Canberra Bike Ride incorporating Amy's Ride is an outdoor event and will proceed notwithstanding inclement weather conditions on the day of the Big Canberra Bike Ride incorporating Amy's Ride. Pedal Power ACT is not liable to any Rider for any loss, damage, cost or expense of any kind including, but not limited to, refund of entry fees, in the event of poor weather before or during the Big Canberra Bike Ride incorporating Amy's Ride.
  2. Pedal Power ACT reserves the right, in its absolute discretion, to refuse to allow a Rider to participate in the Big Canberra Bike Ride incorporating Amy's Ride or to remove a Rider from the Big Canberra Bike Ride incorporating Amy's Ride for breach of these terms and conditions or if it otherwise determines it appropriate to do so.
  3. Pedal Power ACT is not liable to any Rider for any loss, damage, cost or expense of any kind, including but not limited to, the refund of the entry fee, including when the Rider is denied access to or is removed from the Big Canberra Bike Ride incorporating Amy's Ride for any reason.
  4. 'Pedal Power ACT' means Pedal Power ACT Incorporated ABN 98 440 716 821, the ‘AGF’ means The Amy Gillett Foundation ABN 46 200 981 503 and includes where appropriate Pedal Power ACT employees, agents, contractors, officials and volunteers.
